These Terms & Conditions (“Terms”) govern your use of the website located at thecurators.au (the “Site”), operated by The Curators Pty Ltd (“we,” “us,” or “our”), a company registered in Victoria, Australia.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms apply to your use of the Site only. Any engagement of The Curators for services (UGC, mass seeding, influencer campaigns, or any other commercial work) is governed by a separate written agreement between us and the client. Nothing on this Site constitutes an offer to provide services on any specific terms.

Who can use the Site

You may use the Site if you are at least 16 years of age. By using the Site, you represent and warrant that you meet this requirement.

If you are accessing the Site on behalf of an organisation, you represent that you have the authority to do so and to bind that organisation to these Terms.

Permitted use

The Site is provided for informational and inquiry purposes. You may:

  • Browse and read content on the Site
  • Submit information through forms (such as the contact form or proposal request)
  • Share or link to publicly available pages of the Site

You may not:

  • Use the Site for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to any part of the Site, or to systems or networks connected to it
  • Use any automated system (bots, scrapers, crawlers) to access the Site, except for legitimate search engine indexing
  • Reproduce, copy, sell, or commercially exploit any part of the Site or its content without our prior written consent
  • Interfere with the operation of the Site or its security
  • Submit false, misleading, or harmful information through any form on the Site

Information you submit

When you submit information through forms on the Site (such as your name, email, brand, or campaign details), you confirm that:

  • The information is accurate and submitted by you (or with the authority of the person it relates to)
  • You consent to us using the information to respond to your inquiry and, where relevant, to assess a potential engagement

Intellectual property

Our content

The Site, including its design, layout, code, text, graphics, trademarks, logos, and original content (such as page copy, blog posts, and case study writeups), is owned by The Curators Pty Ltd or licensed to us, and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and view the Site for personal, non-commercial use. All other rights are reserved.

Creator and client content

Some content on the Site (including imagery, video, and testimonials) is provided by creators or clients with their permission for the purposes of showcasing our work. We do not claim ownership of this content beyond the rights granted to us for use on the Site.

If you are a creator or client featured on the Site and would like content removed, please contact us at hello@thecurators.au and we will respond promptly.

Brand names and trademarks

Brand names mentioned on the Site (including but not limited to clients, creators, platforms, or third-party services) are the trademarks or registered trademarks of their respective owners. Their mention on the Site does not imply endorsement of The Curators unless explicitly stated.

Third-party services and links

The Site embeds and links to third-party services and content, including:

  • Calendar booking via Calendly
  • Web fonts and analytics services
  • Social media platforms (Instagram, TikTok, LinkedIn)
  • Client and creator websites referenced in case studies and blog posts

These third-party services are governed by their own terms and privacy policies. We do not control them and are not responsible for their content, practices, or availability.

We are also not responsible for the content of external sites we link to. Following a link to an external site is at your own discretion.

Newsletter and email communications

We do not currently operate a marketing newsletter. If we introduce one in the future, we will only send marketing emails to people who have actively subscribed, and you will be able to unsubscribe at any time using the link in any such email.

If you submit a contact form or proposal request, we will respond directly to your inquiry. This is not considered marketing communication.

Disclaimer

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties, express or implied, about the Site, including:

  • That the Site will be available, uninterrupted, secure, or error-free
  • That the information on the Site is accurate, complete, or current at all times
  • That the Site is free from viruses, malicious code, or other harmful elements

You use the Site at your own risk.

The information on the Site is general in nature and is not intended as advice (legal, financial, marketing, or otherwise). Engagements with The Curators are governed by separate written agreements that contain the specific terms applicable to that work.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantees, conditions, warranties, or rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any equivalent legislation that cannot lawfully be excluded.

Where we are permitted by law to limit our liability, our total liability arising out of or in connection with your use of the Site is limited (at our option) to:

  • Resupplying the relevant content or service; or
  • Paying the cost of having the content or service resupplied.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site, including any loss of profits, data, business, or goodwill — whether based on contract, tort, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Indemnity

You agree to indemnify and hold The Curators Pty Ltd, its directors, employees, and contractors harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Your misuse of the Site
  • Your violation of any applicable law or third-party rights

Suspension and termination

We reserve the right to suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms or applicable law.

The provisions of these Terms that by their nature should survive termination — including those relating to intellectual property, disclaimers, limitation of liability, indemnity, and governing law — will survive.

Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when the Terms were last revised. Material changes will be communicated through a notice on the Site or by other reasonable means.

Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

Governing law and jurisdiction

These Terms are governed by the laws of Victoria, Australia. You and we agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia in connection with any dispute arising out of or in connection with these Terms or your use of the Site.
